ORDERING
To place an order with Sima G., you must contact us directly through email at sima@simagltd.com or by phone at 212.664.1010. You may be asked to provide a form of photo identification on your first purchase.
SHIPPING/WHEN PAYMENT IS DUE/RETURNS / REFUNDS
SHIPPING
All orders are shipped, fully insured, for a flat fee of $75.00 per shipment (within the United States) and $200 per shipment (outside of the United States). Sima G. reserves the right to change this fee in its sole discretion. You are responsible for all applicable local taxes and fees, custom duties, import taxes and local clearance fees applicable for your country.
Shipping is currently not possible to Cuba, Iran, North Korea, Sudan, Syria and any other country that is, at the time of shipping, subject to US or international embargoes.
Shipping may be restricted due to material composition and may be held in customs at your country.
Shipments are sent Monday thru Friday only, excluding holidays. Please allow 2 business days for your order to be processed. Any orders placed after 3pm EST will be processed in the next business day. You must sign for all orders on delivery. International orders can be shipped only to the matching billing address with the credit card that is used.
WHEN PAYMENT DUE
All purchases must be paid for in full at the time an order is placed.
Items that have been made to order or engraved are FINAL SALE.
WEBSITE TERMS & CONDITIONS
By using the Sima G. website, you are deemed to have read and accepted the following Terms and agree to comply with and be bound by all applicable laws and regulations, including United States export and re-export control laws and regulations.

USE OF THE SITE
Subject to the Terms, Sima G. hereby grants you a limited, nonexclusive, revocable, non-transferable and non-sublicensable right to access, display, and view the Site and the Content for personal, non-commercial use. Any breach of this Agreement shall result in the immediate revocation of the license granted in this paragraph without notice to you.
User shall abide by all copyright notices, information, and restrictions contained in any Content accessed through this Site.

Sima G. may assign you a password and account identification to enable you to access and use certain portions of this Site. Each time you use a password or identification, you will be deemed to be authorized to access and use the Site in a manner consistent with the Terms, and Sima G. has no obligation to investigate the authorization or source of any such access or use of the Site.

OWNERSHIP
This Site is owned and operated by Sima G. All right, title and interest in and to the Content provided on this Site are owned either by Sima G., developers or vendors ("Third Party Providers"). Except as otherwise expressly provided by Sima G., none of the Content may be copied, reproduced, republished, downloaded, uploaded, posted, displayed, transmitted or distributed in any way and nothing on this Site shall be construed to confer any license under any of Sima G.’s intellectual property rights, whether by estoppel, implication or otherwise. BILLING AND PAYMENTS
Paying By Credit Card
When you place your first order, please note that we will not save your credit or debit card information, unless you opt to have us do so. If you elect to have us save your credit card, it will be the default method of payment on any future shipments, unless you elect to purchase with a different form of payment. We accept the following credit cards at this time: American Express, VISA, MasterCard and Discover Card. There is a 3% processing fee added to all payments made by credit card.
Paying by check or bank wires.
We accept checks and bank wires as forms of Payment.
Proof of sent bank wires must be received within 3 days of purchase. The item will not ship until your bank wire or check has cleared the bank. This takes approximately 1 to 3 business days. The item will be on hold until this occurs. Sales tax of 8.875% will be added to all items shipped in New York. Please contact us for bank wire details.
Agreement Changes
We may in our discretion change these Terms, Sima G.'s Terms and Conditions and/or Sima G.’s Privacy Policy without notice to you. WE WILL POST MATERIAL CHANGES TO SUCH TERMS AT THIS WEBSITE AND ENCOURAGE YOU TO CHECK BACK FREQUENTLY. YOUR CONTINUED USE OF THE SITE AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES.

The laws of the state of New York govern the interpretation of this Agreement and any disputes arising in connection with it, regardless of conflict of laws principles. Any claim or dispute between you and Sima G. that arises out of or relates to this Agreement shall be resolved by binding arbitration to be held in New York City pursuant to these Terms. You hereby agree to waive any right to trial by jury in any dispute.
LOCAL TAXES
You may be charged local sales tax, if applicable.
INTERNATIONAL ACCESS
This Site may be accessed from countries other than the United States. This Site may contain products or references to products that are not available outside of the United States. Any such references do not imply that such products will be made available outside the United States. If you access and use this Site outside the United States, you are responsible for complying with your local laws and regulations.

AUTHENTICATION AND CERTIFICATION
YOU ACKNOWLEDGE AND AGREE THAT SIMA G.’S AUTHENTICATION AND GEMOLOGICAL PROCESSES ARE IN-HOUSE AND INDEPENDENT. BRANDS IDENTIFIED ON THE SITE ARE NOT INVOLVED IN THE AUTHENTICATION OF THE PRODUCTS BEING SOLD, AND NONE OF THE BRANDS SOLD ASSUMES ANY RESPONSIBILITY FOR ANY PRODUCTS PURCHASED FROM OR THROUGH THE WEBSITE. BRANDS SOLD ON THE SITE ARE NOT PARTNERED OR AFFILIATED WITH SIMA G. IN ANY MANNER. HOWEVER, SIMA G. AUTHENTICATION AND CERTIFICATION
YOU ACKNOWLEDGE AND AGREE THAT SIMA G.’S AUTHENTICATION AND GEMOLOGICAL PROCESSES ARE IN-HOUSE AND INDEPENDENT. BRANDS IDENTIFIED ON THE SITE ARE NOT INVOLVED IN THE AUTHENTICATION OF THE PRODUCTS BEING SOLD, AND NONE OF THE BRANDS SOLD ASSUMES ANY RESPONSIBILITY FOR ANY PRODUCTS PURCHASED FROM OR THROUGH THE WEBSITE. BRANDS SOLD ON THE SITE ARE NOT PARTNERED OR AFFILIATED WITH SIMA G. IN ANY MANNER. HOWEVER, SIMA G. FULLY COOPERATES WITH BRANDS SEEKING TO TRACK DOWN THE SOURCE OF COUNTERFEIT ITEMS, WHICH INCLUDES REVEALING THE CONTACT INFORMATION OF CONSIGNORS SUBMITTING COUNTERFEIT GOODS. WITH RESPECT TO JEWELRY, PRECIOUS STONES AND SEMI-PRECIOUS STONES, SIMA G. PERFORMS SUCH IN-HOUSE INSPECTION AS IT DEEMS PROPER AND DOES NOT ENGAGE THE SERVICES OF A GIA-CERTIFIED APPRAISER, EXCEPT AS SPECIFICALLY NOTED ON THE SITE.
INDEMNITY
You will indemnify and hold harmless Sima G. from and against any and all fines, penalties, liabilities, losses and other damages of any kind whatsoever (including attorneys’ and experts’ fees), incurred by Sima G. and such parties, and shall defend Sima G. and such parties against any and all claims arising out of (1) your breach of these Terms and Use; (2) your breach of the Terms of Service; (4) fraud you commit, or your intentional misconduct or gross negligence; or (5) your violation of any applicable U.S. or foreign law or the rights of a third party. Sima G. will control the defense of any claim to which this indemnity may apply, and in any event, you shall not settle any claim without the prior written approval of Sima G.
FORCE MAJEURE
Sima G. shall be excused from performance under these terms of service, to the extent it is prevented from or delayed from performing, in whole or in part, as a result of an event or series of events caused by or resulting from (1) weather conditions or other elements of nature or acts of God, (2) acts of war, acts of terrorism, insurrection, riots, civil disorders or rebellion, (3) quarantines or embargoes, (4) labor strikes, or (5) other causes beyond the reasonable control of Sima G. In the event that Sima G. is temporarily unable to ship to you a purchased item because of such an event, Sima G. will give you the option of deferring shipment or receiving a refund of your charges.
TYPOGRAPHICAL ERRORS
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing, Sima G. shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Sima G. shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Sima G. shall immediately issue a credit to your credit card account in the amount of the charge.
REMEDIES
You agree that Sima G.'s remedy at law for any actual or threatened breach of this Agreement would be inadequate and that Sima G. shall be entitled to specific performance or injunctive relief, or both, in addition to any damages that Sima G. may be legally entitled to recover, together with reasonable expenses of any form of dispute resolution, including, without limitation, attorneys' fees.
No right or remedy of Sima G. shall be exclusive of any other, whether at law or in equity, including without limitation damages injunctive relief, attorneys' fees and expenses.
No instance of waiver by Sima G. of its rights or remedies under these terms and conditions shall imply any obligation to grant any similar, future or other waiver.

You agree that we may update your information with information your bank or credit card issuer may supply, or other information available to us. All such personal information is subject to the Sima G. Privacy Policy, incorporated into this Agreement. We are not responsible for any fees or charges that your bank or credit card issuer may apply. If your credit card issuer reverses a charge to your credit card, we may bill your account directly and seek payment by another method including a mailed statement.
